Property Division in California

All property subject to a divorce must be carefully identified and characterized. In California, Property is defined either as community property or separate property. Community property is generally any property acquired during a marriage. There are a few limited exceptions, including money or other assets gained from an inheritance as gift. Separate property is generally any property acquired prior to marriage, through inheritance or gift.

All community property is subject to division. If the parties are unable to reach an agreement, the court will generally divide community properly equally. Some exceptions exist, including cases in which one party has misappropriated marital assets. Of course, property division is just part of the overall financial structure of a divorce, which may also include child support and/or spousal support (alimony).
