Prenuptial Agreement Attorneys

A prenuptial agreement, or Prenup, is a contract entered into by individuals prior to marriage that may significantly affect their rights in the event of a divorce. California courts may uphold prenuptial agreements that are properly created and executed. However, California courts have on many occasions chosen not to enforce prenuptial agreements due to lack of full financial disclosure and other defects in the creation, review or execution of an agreement.

A post-nuptial agreement, or PostNup, is a contract entered into by a couple after they have been married. Like prenuptial agreements, post-nuptial agreements may significantly affect the financial rights of each spouse. Post-nuptial agreements may be enforced by a California court if properly created and executed. As with a prenuptial agreement, any party entering into a post-nuptial agreement should retain a lawyer.
